These General Terms and Conditions (GTC) apply to all bookings made by the customer for services from Argonaut Technologies GmbH ("ARGONAUT") and form part of the contract for the training contract chosen by the customer and concluded with ARGONAUT. The bookings are strictly personal and cannot be transferred or assigned to third parties. The conclusion of the training contract requires a minimum age of 18 years. In the case of underage members, a written declaration of consent from at least one legal representative is required.
ARGONAUT provides the technical infrastructure and cloud services to operate AURUM One training machines. All services for customers to perform trainings on the AURUM One training machines are stipulated in the training contract of the training service provider ("TRAINING PROVIDER").
ARGONAUT is not liable for (i) a customer’s injuries and illnesses due to defective or poorly maintained fitness premises and equipment and (ii) otherwise only in the event of intent or gross negligence on the part of the TRAINING PROVIDER. Any further liability for direct or indirect damage is excluded to the extent permitted by law. It is up to the customer to take out respective insurance.
The customer assures that at the time the contract is concluded, he is in a state of health required to perform a High Intensity Training or, in case of doubt, has informed his family doctor about the required state of health. If the TRAINING PROVIDER has doubts about sufficient state of health of a customer, he can request a written confirmation from the doctor to determine the required state of health. If an inadequate state of health is determined during the examination,the TRAINING PROVIDER can reject the customer.
The General Terms and Conditions shall be governed exclusively by Swiss law. The exclusive place of jurisdiction for all disputes arising from the General Terms and Conditions shall be Zurich 1 in Switzerland. In any legal dispute the German version of the General Terms and Conditions or a contract shall have priority over versions translated into any other language.
